Hi Chris--I am very aware of the escalating maintenance fees as I have a penthouse unit. If you have never been on any of the penthouse floors, they are embarrassing in terms of their "décor." It's like walking into the 1950's Catskills "resorts." There are steps in some of the hallways and units which certainly are not up to handicapped standards and the leopard print carpet in the dark hallways is hideous. I am pretty knowledgeable in real estate law and homeowners association law. Part of the reason I posted what I did is because people need to know that owner information is public information. Also, in the state where I live (not New York), it is illegal for homeowners associations to disseminate homeowner contact information unless the association has a signed release from each owner. Something like this could be the reason for TMCNY being unwilling to provide it to you (although I doubt it)). Don't misunderstand, I am not making excuses for Eichner, the Board, and top management employees, I am merely stating that something like this could be a possibility. Our privacy laws are getting a bit out of hand. Having purchased my unit on the secondary market, I never went through the sales meetings where deceptive information was given to prospective owners and since I live quite far from NY, I always book my time about 10 months in advance, thus never having any problems getting the dates that I want. I have been outraged at hearing some of the things prospective buyers have been told and even more outraged that owners have not been able to use their nights for years, in some cases. Please know that I fully support the actions being taken by the owners and the investigation by the Attorney General. Please know, too, that investigations of this nature and court filings can take many years before completion.
