I agree Rosemary, this is really hard to take. However, these are for short term rentals. You can't book months out for $134 per night. When you consider all the folks not paying maintenance fees, there must be a lot of empty rooms. I don't blame TMC for getting a few bucks for them rather than letting them sit empty. The big question is, whose pocket does the $134 go into?

Just some thoughts:Today I re-read the settlement between the Manhattan Club and the Attorney General’s office. From what I understand “BlueGreen” will need to take over management by this July if they have not already. With so many owners refusing to pay maintenance fees it should be interesting to see how “BlueGreen” handles the matter. Also I am curious to see if they will change to a point system and/or lower maintenance fees. Since the second payment from the settlement was recently issued I assume the third and final payment will not be forthcoming for at least several more months.

Reading discussions about receiving a check, I have been a member for 20 years and current on maintenance fees. Should I have received one of these checks?

I received a check 3 years ago for $52. Nothing last year. Just received a check for about $202 this year. I received the first 2 checks in August. The settlement cycle was supposed to last for 3 years. I think its over and after they finish sending checks for this cycle...that's it...I don't think there will be any more checks forthcoming.

I live in the state of Virginia. I have been a Manhattan Club owner since 2011. Have always paid the maint. fees. Did not hear anything about this lawsuit until last year. Found out accidentally online. Have never received a single letter or email concerning this whole thing. Whats more... to hear that the club is still operating in full swing... just as it had been operating before and people are only getting checks of $200 or less. Well, that tells me there is something rather fishy going on here.

I bought in with Blue Green. Blue Green has always been my point of contact for booking the Manhattan Club. They use both a point system and maintenance fees. The maintenance fees I pay have increased in October each year for the past three years. Although... I don't pay the amounts as some I have read about here.

Anyone have any consolidated information on who we can all contact as one voice?

According to the correspondence I received from Mr. Solomon from the District Attorney’s Office the recently distributed settlement checks are the second of “three” scheduled payments to eligible owners. The first was for those that had paid their maintenance fees and had not been able to reserve reservations during the stated period. The second and third payments are scheduled to be distributed to those that were/are fully up-to-date with maintenance fees. As I stated in my last post, since the second payment was just recently distributed I do not believe the third payment will be forthcoming for at least the next few months. This is just an FYI. I realize some owners are not interested in these payments from the settlement. These settlement checks between NYS and the Manhattan Club have no connection with the legal proceedings by Mr. Zimmerman.

Chris, what I was trying to clarify was the settlement between the District Attorney’s Office and the Manhattan Club from 2017 is separate from Mr. Zimmerman’s current legal procedures. There seems to be some confusion from some current and former owners concerning the eligibility and payment of this settlement. Zimmerman was not involved in the settlement between New York State and the Manhattan Club.

got it!!

the $$ check received is due to the former nysag's so-called SETTLEMENT (a farce if i ever saw one.) the settlement amount received by some of us was not due to any legal action by jean-marc zimmerman's (esq).

your clarification is correct and called for. i'm hoping mr zimmerman will do much better for his clients/TMC owners than eric schneiderman, the former nysag.

The settlement between the NY State Attorney General and TMC/Eichner entities was UNFORTUNATELY mostly for the benefit of NY State (a little restitution for various licensing, registration, and business infractions PLUS forcing Eichner out of the timeshare business). Unfortunately the state did not take on the cause of the 14,000?owners who were or felt defrauded. Individual owners previously and Zimmerman now, have pursued their fraud-related cases in the court system. A few have and are currently succeeding in small claims court after years of valiant efforts, time, and some expenditures.

Some owners expected the AG to help Owners either get out of their contracts, or liquidate the TMC and return funds to owners or what have you. The AG apparently decided not to go that route, and was probably an unrealistic expectation. This type of legal action is typically left to class action legal processes which are fraught with its own set of problems. Years and years of accumulating Legal expenses being the primary problem.

I have tried to reach out to Attny Zimmerman twice and did not receive an email response nor a returned phone call. What are the charges Attny Zimmerman is bring up against TMC for each plaintiff?

Depending on.my memory. I have no insight info Zimmerman’s current activity. I BELIEVE that the original action was taking up the cause of an owner who wanted to run for the Owners Board, and to do so, needed access to all owners’ contact information. Of course TMC resisted, appealed and used the legal system and processes to thwart those attempts. Not sure where it stands now. (Zimmerman may have expanded his efforts). You’ll probably get no information here on current thinking or strategy because ‘walls have ears’. TMC undoubtedly monitors these conversations.

John Zimmerman is doing his due diligence and he said it’s going to take a few months or possible years but he is fighting for us. They have deep pockets and are doing anything they can to delay any motions. If u give him a call he will update u
