Cancelling within 10 days

The package that you received when you bought it should have the address to which to mail. What company did you buy from?
Your letter of rescission must also include the signatures of everyone who signed when it was bought. It does not have to be fancy or detailed. You do not have to state your reason(s) why you are canceling.
Also, make sure you send it via the method mentioned in the contract. Likely it will be via certified mail.

I hope so too. The one thing I forgot to mention is that you should send it certified and ask for a receipt. That way, you have proof that you mailed it on time. When you mailed it is what counts, not when it is received.
Here are a couple of other things to keep in mind. Once they receive your rescission letter, they have up to 45 days to refund your money. That period of time might vary from state to state. Keep watch on your credit card activity to see if/when you get refunded. Keeping that in mind will prevent you from needlessly contacting the resort or timeshare company asking when the refund will come.
Also, it's possible that, once they receive your rescission letter, someone from the resort or sales team will try phoning you to tell you to change your mind. Watch out for such calls. What has been reported on boards like these is that they will try to give you some extra perks or credit if you keep your purchase. Some might also give you strange threats telling you that you will face serious financial or legal ramifications if you rescind.

I mailed it First Class, Certified, and Return Receipt. How do I stop them from charging me on my card. The only thing I could do to my account was disabling automatic payments for my monthly charges. But we do have a balance of $499 to be paid by 7/07/2109. I couldn’t edit that.

Hi I’m dealing with the same situation. I don’t know how to go about with writing the note. Can you help me by letting me know exactly what I can write? I was out in Orlando with my 2 daughters mom and boyfriend and we got scammed. I didn’t even agree for them to check our credit scores or to apply for a credit card which we still got denied for. There’s more lies from them to us but right now I just need to know what I can write I really need this thing to get cancelled.

Cynthia G.: Look through your sales contract for the information on how to cancel the timeshare contract, and then follow it precisely. Many timeshare contracts will include a form you will need to fill out to cancel the timeshare. If your timeshare contract doesn’t come with a timeshare cancellation form, then you will need to write a cancellation letter to the timeshare resort.
In your letter include the exact name(s) written on the timeshare contract, the timeshare contract number and the date of purchase of the timeshare. Let them know the purpose of your letter is to cancel your timeshare contract and that you have the right to do so according to your contract and state law. Request all money paid be returned and your loan canceled, if applicable. Sign and date the letter.
Be sure and send your letter "Certified Mail with a Return Signature and Receipt” so you have proof the letter was sent within the time period allotted and it was received by the timeshare company. Also make sure the cancellation letter is mailed to the address specified in your contract.

An important question: When did you sign this. You have 10 days from the time you and all the others signed it to get your rescission letter in certified mail.

So me and my wife went through this purchase as well. We sent a letter to cancel the contract as instructed. Contract stated we could send through mail, fax, or email. We did all three to just be sure. Made copies and got receipts. We got a call to discuss about the refund. Should we answer the next time they call or just ignore it and let it all follow through? Thanks in advance.

Don't discuss anything with them . They are going to try to get you to change your mind and they are very good at what they do . Demand your refund and cancellation or you will notify the Attorney General in your state and the state they do business in . Be firm and don't let them talk you out of canceling . If you paid by credit card file a dispute with your card carrier immediately to prevent them from keeping your money . Let us know what happens down the road .

I am missed my 10 days period. I am not financially ok now. Is there any way for me to get out of Exploria exploitation? I have written them but these guys are not ready to let me go. Any idea that can help me come out of this mess will be appreciated. Wally

And yes, renting units from owners rather than purchasing is rarely a bad idea. I'm sure there a lot of owners out there right now who envy your position.

I signed up about a year ago with Exploria resorts. I missed the 10 days grace period. How can I exit from Exploria’s net. I am really sick and tired of this legal fraud I found myself. Please if anyone knows what I can do don’t hesitate to let me know . Wally

I purchased the timeshare last Oct. 16 and send the notice of cancellation Oct. 18 but Purolator said it will be delivered by October 22 Tuesday since there was no delivery Sat and Sun. Am I still in the rescission period? Can I still cancel the timeshare contract and refund the deposit?

What did the instructions say about sending your rescission letter? Did it tell you to send it via certified mail? That's usually the case. Check again. If so, send it via certified mail ASAP and ask for a receipt. The receipt will show the day you sent it and that is what counts, not the day it was received.

It says that the “Notice of cancellation may be delivered personally to the developer or sent by certified mail, return receipt requested, or sent by express, priority or recognized overnight delivery service with proof of service, to the business address of the developer”. Is Purolator pertains to mentioned above? I delivered it via Purolator express and I received their email notification of the shipment progress or tracking that includes the day I sent it and estimated delivery. But Im not sure if the receiver/ developer would be able to notify by Purolator or will know that I sent it on time Oct. 18 that was less than 5 days. I called the Purolator customer service and they said I should provide the developer/receiver the tracking no. There was no business phone number of the Rescission Department of Starpoint Resort Group Las Vegas, the developer. But I do have the phone numbers of Sapphire Resorts and the quality assurance Representative. Should I call them and give the tracking no? Thank you so much for your reply.
