As long as you have followed the rescission instructions carefully and sent in your rescission letter within the allotted time, the developer is required to refund you.

One word of caution. You (understandably) sound anxious about this. However, do not go calling the resort asking about the progress of your refund. The people there might try to hound you about not rescinding.

Hi Lance C. Thank you so much for your response and advice. Yes you are correct that I'm so anxious. I still feel very frustrated even I sent my letter within the rescission period. I'm afraid they might find any reason to not cancel my contract.

However, your response makes me a bit relief. Thanks again.

As long as you followed the rescission instructions properly, they have no reason to refuse to cancel. They are required by law to cancel. The other reason why they might not cancel is if you contact them (or they contact you) and they beg you over the phone to change your mind and you agree. That's why I recommend not contacting them about the progress of your rescission request and that you watch out for any unfamiliar phone calls coming your way.

The rescission instruction is to mail a letter to the address provided within 10days. When I asked the sale manager(he called me after I email him with few questions) he told me that I don’t have to mail any letter just let him know I want to cancel. However, I don’t really trust him cuz the instruction in my contract is to mail a cancellation letter. I mailed the letter and also sent an email to the sale manager and cc to my sale representative to let them know my decision. Only my sale representative has called me once as soon as she received my email.

Since then I have not heard from anyone else.

I hope the process is going smoothly. I felt my life is ruined since I signed the contract

Hi Lance, It has been 2 weeks since I sent my cancellation letter, but still I haven’t heard anything. In my purchase agreement it said “the refund shall be made within 20days after they receive the letter”. My question: if I won’t receive my refund in 20days as said, what should I do? Should I contact them? Or should I dispute the amount with my credit card? Thank you so much for any advice. I appreciate your time answering my question.

I would dispute the charge with your credit card company showing that you mailed your rescission letter within the allotted time. Also,don't panic. Legally, they have up to 45 days to refund your money. Remember to monitor your credit card activity to see if the money has been refunded.

And do not call. Phone calls have no legal weight. All the people will do is berate you into changing your mind about rescinding the way the berated you into buying in the first place.

With all due respect to Lance, think you should definitely call the timeshare company to find out if they received rescission notice. If they try to upsell you, just ask to speak with a supervisor in the legal department. Don't put up with any sales talk. Brand name companies should respond. If not, I will write about their refusal to honor a rescission document and steer you to consumer groups that may be able to assist.

Well, I'm just glad you got your refund. You're one of the fortunate ones who found a website like this and was able to rescind your purchase. Many did not find this in time and then got stuck paying tens of thousands for something that they either can not use or could have bought resale for a fraction of the cost.

Hi! We just freshly purchase a timeshare this morning and we just felt pressured at Westgate Resort and Villas at Kissimee Florida. We were just here for vacation and we stopped by the info center as they advertised b1g1 tickets for legoland at one billboard as we enter FLorida state. And boom we didnt realized we right away that we would be sitting on a timeshare presentation. So we want to rescind our contract and i want to know the address we need to send it to? Is it the same address of the property we went to this morning which is 7700 westgate blvd, kisimme florida . Dont want to miss the 10days period pls help

My experience was with Vistana. Please carefully read the document you received from them, instruction to mail your letter should be written somewhere in that document. I had to mail my rescission letter to a different address, not to the resort where I bought the timeshare.

I just went through the contract i got and i found it. Thanks. I got to mail the owner’s kit and tablet too coz it says there on cancellation they will charge me $50 for owners kit and $150 for tablet if they dont receive it back.

Mine doesn’t mention that, just where and how to mail the letter. However, I mailed back the kindle too, but in a separate package. Make sure you follow the instruction of how to mail ur rescission letter properly. Mail as soon as possible within that 10day. Hope you get it cancelled smoothly.

I just mailed my letter today. I also mailed the owners kit and tablet separately. I include the copy of the tracking of the package. It will get to their office on tuesday nov12. That’s 2business days from day of purchase. I hope we will be able to cancel it without a problem.

We just got our deposit back to our card. We were just thankful we search about these westgate timeshare after we just sign the contract and we wont be dealing with these scam. Thank you guys
